Terms and Conditions of NovaHiring Service
1. General
These terms of use (the “TU”) establish your relationship with NovaHiring (the “Company”) and govern your access, navigation and use of the website (the “Site”). By accessing the Site, you agree to these TU. If you do not agree to these terms, please refrain from using the Site. For any questions, you may contact us at candidates@novahiring.com.
By accepting these terms and conditions, you declare that:
You have read, understand and agree to the terms set forth herein.
You have sufficient capacity to contract products and/or services.
If you are acting on behalf of a legal entity, you have sufficient and valid power of representation.
You are of legal age.
2. Purpose of the Site
The Site is designed to provide general and commercial information about the Company and for users who have created an account to be able to use the services offered, which include the optimization of talent attraction, management and retention processes, among others (collectively referred to as the “Services”).
3. Information Available on the Site
We make every effort to ensure that the information on the Site is accurate and up-to-date. However, all information is provided for informational purposes and the Company does not guarantee or accept liability for errors. We encourage you to periodically review any updates or changes to the content.
4. Authority to Enter into These Terms
Use of NovaHiring Services is subject to acceptance of these Terms. You must have the legal capacity to enter into these terms, either as a natural person over 18 years of age or with valid authorization from a legal representative, or as a duly constituted legal entity.
The Terms are accepted upon any of the following events:
You receive confirmation of account creation and the necessary credentials to access.
You access NovaHiring Services that do not require the creation of an account.
You may not access NovaHiring Services for production, if you are a competitor of NovaHiring, to monitor the availability, performance or functionality of the Services, or for other competitive purposes, without prior written consent.
5. Use of the Site
You agree to use the Site in compliance with applicable law and public order. You must not use the Site for unlawful purposes, to interfere with or damage the Site or the Services, or to act contrary to the legitimate rights and interests of the Company or third parties.
You must refrain from:
Committing crimes or inciting others to do so.
Introducing computer viruses or posting offensive material.
Hacking the Website service.
Corrupting the Website data.
Sending unsolicited advertising ("spam").
6. Responsibilities
You will indemnify and hold the Company and its associates harmless from any claim, loss, expense, damage, or liability arising from your misuse of the Site, breach of these TOU, or any other obligation.
7. Responsibility
We strive to ensure the availability and functionality of the Site, but we do not guarantee that it will always be available, uninterrupted or error-free. We will not be liable in the event of:
Technical errors due to force majeure or similar.
Maintenance affecting the availability of the Site.
Damages arising from content on the Site.
Incorrect or unlawful use of the Site.
Unauthorized access to the Site or Services.
Conflicts between users.
Content uploaded to the Site.
7.1. Obligations and guarantees of NovaHiring
We undertake to keep the service available 24 hours a day, every day of the year, although we are not responsible for interruptions attributable to third parties or force majeure.
We reserve the right to interrupt the service for repairs, maintenance, changes or improvements, and, where possible, we will notify in advance.
7.2. User obligations
Complete the identification and registration forms with truthful data.
Inform NovaHiring of any change in the data that affects the contractual relationship.
Make payment for the service as established.
7.3. Customer Data Protection
NovaHiring will maintain administrative, physical and technical measures to protect the security, confidentiality and integrity of Customer Data. These measures include preventing unauthorized access and complying with applicable data protection laws.
8. Product and/or service contracting
8.1. Main characteristics of the goods
The main characteristics of the goods and/or services offered can be consulted in the corresponding descriptive sheet on the Website.
8.2. Purchase procedure
NovaHiring will keep electronic proof of the contract made by the User. The purchase procedure includes:
Registration for a free 7-day trial period.
Upgrade plan at any time during the trial period.
Checkout process including tax and bank details.
8.3. Price and payment methods
The prices indicated on the Website do not include VAT and are expressed in Euros (€). Payment methods include bank card and direct debit.
8.4. Right of withdrawal
If you reside in the EU or the United Kingdom, you can cancel your subscription within 14 days from the date of registration. To exercise this right, please contact candidates@novahiring.com.
9. Intellectual and industrial property
All works, brands, software and other content available on the Site are the property of the Company or licensed to it. You may not reproduce, distribute, modify or exploit these contents without express authorization.
10. Privacy and Cookie Policies
The use of the Site and/or the Services may involve the collection and processing of information, including personal data, in accordance with our Privacy and Cookie Policies.
11. Links to third-party websites
We are not responsible for third-party websites linked from the Site. We have no obligation to review such content, services or products, and we do not endorse or guarantee them.
12. Modifications to the Site
We reserve the right to update, remove or modify the Services and the Site, and to remove access to them, upon reasonable notice.
13. Applicable law and dispute resolution
These T&Us will be governed by Spanish law. If you act as a consumer, you can consult the European Union's online dispute resolution website.
14. Miscellaneous
The invalidity of any section of these T&Us will not affect the validity of the rest. Any resignation must be in writing and signed by a representative of the Company.
